By accessing or using the BlackForge Arms website, mobile applications, or any of our services, you agree to be legally bound by these Terms and Conditions and our Privacy Policy. If you do not agree to any part of these terms, you must not use our services.

These terms apply to all visitors, customers, and others who access or use our services. We reserve the right to update these terms at any time. Material changes will be communicated by email and by posting the updated terms on this page with a new effective date.

By placing an order for a firearm, you represent and warrant that:

• You are at least 21 years of age for the purchase of handguns, and at least 18 years of age for long guns
• You are legally permitted to purchase and possess the firearm in your state and local jurisdiction
• You are not a prohibited person under 18 U.S.C. § 922(g) or any applicable state law
• All information provided at checkout is accurate and complete
• You will complete all required background checks through your designated FFL dealer

Making a false statement in connection with a firearms purchase is a federal felony. BlackForge Arms fully cooperates with all law enforcement inquiries.

All firearms sold by BlackForge Arms must be transferred through a Federal Firearms Licensee (FFL) dealer in your area. This is required by federal law and cannot be waived.

• You are responsible for identifying and providing the correct FFL dealer information at checkout, including their license number, phone number, and physical address
• You are responsible for all background check fees and transfer fees charged by your local FFL dealer. These fees vary by dealer and are not included in your order
• BlackForge Arms will contact your FFL dealer directly to arrange the transfer once your order is processed
• If your FFL dealer rejects the transfer or is unable to receive the shipment, you will be responsible for any return shipping costs

BlackForge Arms makes every effort to ensure that product descriptions, specifications, images, and pricing are accurate. However:

• Product specifications are subject to change by manufacturers without notice
• Colors and finishes may vary slightly from those displayed on screen due to monitor calibration
• In the event of a pricing error, we reserve the right to cancel the order and issue a full refund, notifying you promptly
• Product availability is subject to change without notice. We will notify you immediately if an ordered item becomes unavailable

Payment is due in full at the time of order placement. We accept CashApp, Zelle, Apple Pay, Wire Transfer, Bitcoin, and other arrangements listed at checkout.

• Orders are processed and shipped only after payment is fully confirmed
• We reserve the right to cancel any order at our discretion and issue a full refund
• Chargebacks filed in bad faith may result in account suspension and legal action
• Pricing is in U.S. Dollars. You are responsible for any applicable taxes or duties

You may not use our website or services to:

• Purchase firearms for a person who is legally prohibited from owning one ("straw purchases" - a federal felony)
• Attempt to circumvent background check requirements
• Engage in fraudulent transactions or provide false information
• Resell products in violation of applicable laws or manufacturer agreements
• Use automated bots or scrapers to access our site or pricing data

BlackForge Arms shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of our products or services, including but not limited to loss of profits, loss of data, personal injury, or property damage resulting from the use or misuse of any product purchased.

Our total cumulative liability for any claim arising out of or relating to a specific order shall not exceed the purchase price paid for that specific product. This limitation applies regardless of the legal theory under which the claim is made.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions. Federal firearms laws (including the Gun Control Act) take precedence where applicable.

Any dispute arising out of or relating to these terms or your use of our services shall be resolved exclusively in the state or federal courts located in Bernalillo County, New Mexico. By using our services, you consent to personal jurisdiction in those courts.
